Article 1: Use of the Vehicle
The rental is personal and non-transferable.
The renter agrees not to let anyone else drive the vehicle other than those authorized by CHAMA LUXURY. Authorized drivers act as agents of the renter, who becomes fully responsible for the vehicle upon delivery.
The renter is strictly prohibited from:
- Using the vehicle for competitions, training, or illegal activities.
- Participating in races, off-road driving, or vehicle modifications.
- Smoking inside the vehicle or transporting animals.
- Carrying passengers or goods for commercial purposes.
Making any changes to the vehicle or its documents.
The renter also agrees to comply with all applicable traffic laws and ensure the safety and proper use of the vehicle.
Article 2: Rental, Deposit, and Extension
Rental rates include insurance and are payable in advance.
A security deposit is mandatory, refundable after the return of the vehicle in proper condition.
If the renter wishes to extend the rental period, they must obtain prior approval from the lessor.
Any unauthorized extension is subject to an additional charge and may lead to legal action for misuse and breach of trust.
The rental day is calculated from 00:00 to 24:00. Any started day is fully charged.
Article 3: Vehicle Condition
The renter acknowledges having received the vehicle in clean and good condition.
The renter agrees never to tamper with the odometer. If tampering is suspected or the odometer is faulty, a fee equivalent to 300 km/day will apply.
The vehicle must be returned in the same condition, both mechanically and in terms of cleanliness.
If a tire is damaged (puncture, tear, etc.), the renter must replace it immediately with a tire of the same size and quality.
In case of negligence, misuse, or damage, the renter is responsible for repair or replacement costs.
Article 4: Fuel and Lubricants
Fuel costs are the renter’s responsibility.
The renter must regularly check oil, coolant, and other fluid levels, especially during long trips.
The renter is also responsible for refueling with the correct fuel type as specified by the manufacturer.
If the vehicle is delivered with a full tank, it must be returned with the same fuel level.
Article 5: Insurance
The renter is covered by third-party liability insurance, including for their spouse, children, and legal ascendants/descendants within legal limits.
The insurance includes theft and fire coverage, subject to deductibles.
Personal belongings inside the vehicle are not insured.
Damage or theft resulting from negligence (keys left inside, failure to lock, etc.) is not covered.
In case of accident or damage:
- The renter must report it within 24 hours to the police or gendarmerie.
- A written report must include date, time, location, names and contacts of witnesses, and details of the event.
- The renter agrees to cooperate fully with the authorities and the lessor’s insurance.
- The renter will be responsible for repair costs if the responsible third party is not identified.
Important:
Drivers under 21 years old or holding a license for less than 1 year are not covered, unless expressly agreed by the lessor in writing.
Article 6: Vehicle Documents
The renter receives the vehicle registration and all required documents.
If any document is lost, replacement fees will be charged to the renter.
In case of police checks, the renter is responsible for providing valid documents.
Article 7: Liability
The renter is responsible for any fines, traffic violations, customs penalties, or other legal matters incurred during the rental period.
If the vehicle is impounded or detained, the renter will bear all related costs and loss of use.
Article 8: Repatriation of the Vehicle
The renter must never abandon the vehicle.
If the vehicle is left in a different location without prior approval, the renter will pay all repatriation costs.
Article 9: Jurisdiction
In the event of a dispute, only the courts of Marrakech will have jurisdiction.
Legal and administrative fees will be charged to the party found at fault.
Article 10: Legal Notice
Violations committed with rented vehicles are punishable under Article 609 of the Moroccan Penal Code.
